Before you share your health information

 

The My Clover member portal is where you can manage your healthcare and health information. From My Clover, you can access your ID Cards, find a doctor, explore your benefits, and manage data sharing settings with third-party applications that have access to your health information.

What does sharing my data mean?
Clover Health is here to support our members, and this means helping you access your own health information easily.

Easier access also has some risks. Clover is dedicated to keeping your health information private and protected, but once you release your information to a third-party app, we cannot provide any protection in who sees or uses your data.

When you share your health information directly with your healthcare provider or health plan, your information should be protected under federal law/HIPAA. See HIPAA FAQs for more detail, including where to forward any complaints.

The health information that will be shared at your direction includes your profile and demographic information, Clover medical and pharmacy claims information, and a small subset of your lab and medical record diagnosis information obtained as part of health plan operations.

BEFORE you agree to sharing your information with a third-party, read the privacy policy for that app or service to understand how your data will be used. Make sure that you understand the following:

  • What health data is being shared, used and collected?
  • Will the software application collect any other data from you, such as your location?
  • How will your data be protected while being moved and stored--will it be encrypted, de-identified or anonymized?
  • How will your data be used? Will anyone else have access to it? Will it be shared again for any reason? Will it be sold and/or used for advertising or research?
  • Is there any way to limit your permissions to stop additional data sharing?
  • What security measures are being used to protect your health information?
  • Could sharing your data impact others (like family members)?

If the app’s privacy policy does not satisfactorily answer these questions, you may wish to reconsider using the app to access your health information. Your health information may include very sensitive information. You should therefore be careful to choose an app with strong privacy and security standards to protect it.

How do I share my data?

To share your data, you first need to enable data sharing from My Clover:

  1. Go to my.cloverhealth.com and sign in with your credentials or create an account.
  2. Select “Manage data sharing” on the My Clover member portal home page.
  3. Select the “Enable data sharing” button.
  4. Read the information about what you need to know before sharing your health information. Select the “I have read this information” button to continue. You are now enabled to share your health information. Learn more about how to share your health information with a third-party application

What if I no longer wish to share my data:

Deleting the application from your device will not prevent the application from receiving your data from Clover Health. Each application will have its own method of deleting your account and associated data. If the third-party app doesn’t make this available to you and/or you wish to stop sharing your data, you can do this on My Clover.

To remove access to share your data:

  1. Go to my.cloverhealth.com
  2. Select “Share my health information” on the My Clover member portal home page.
  3. Select the “Remove access” button next to the third-party application you no longer want to share health information with.
  4. A pop-up will appear asking you to confirm your choice to remove access. If you still want to remove access, select the “Remove access” button. If you want to continue sharing your health information, select the “Cancel” button.

What if I have concerns that my privacy has been breached?

If you feel that your data has been breached or an app has used your data inappropriately, please see our Privacy Policy for details on how to report this, including filing a complaint with Clover in the following ways:

When a third-party app is hosted or managed by your healthcare provider or health plan, your privacy is covered under HIPAA, which is enforced by the U.S. Department of Health and Human Services’ Office for Civil Rights (OCR). To learn more about filing a complaint with OCR under HIPAA, visit the HHS website where you can File a Complaint. Individuals can also file a complaint with OCR using the OCR Complaint Portal.

Standalone or independent third-party apps are generally not subject to HIPAA but are regulated by the Federal Trade Commission Act, enforced by the Federal Trade Commission (FTC) (see Understanding Mobile Apps). The Federal Trade Commission Act protects against deceptive acts (such as an app that discloses personal data in violation of its privacy notice). Individuals can file a complaint with the FTC using the FTC complaint assistant.
